End User Terms & Conditions

"End User" defines any individual or organization acquiring paid or unpaid services from scholaron.com including viewing and purchasing products eligible for members, using any free or paid tool offered by the website and membership holders contributing material for earning credits.

Creation and Usage of User Accounts

One user may not hold more than one account. Using multiple accounts might result in warnings and restrictions of various levels of severity per the value of damages estimated by ScholarOn management due to the said activity. Username, screen name and other displayable information is up to the discretion of the management and any user shall be asked to modify any displayed information based on abusive, explicit or misleading content notifications. The rights to allow or deny the opening, maintenance and termination of a User Account rest solely with ScholarOn Management. Hiding vital information or using fake information including IP Address, name, mobile or email information, financial information and misrepresentation on any of the above shall compromise the user integrity.

Residence and Age Requirements

All our products and services are aimed at the Higher Education market and hence legal age minors are not expected to use the site or its services. Any legal age minor per the national, regional jurisdiction must get parental, or guardian consent before using ScholarOn or allied websites. The parent or guardian is assumed to have read and agreed to these terms and other parts of ensuing agreements binding on our end users. Any case of identity misuse, unauthorized payments or other problems arising out of minor usage is considered as the responsibility of the parents or guardian of the legal age minor in question. Discovery of an end user being not of the legal age per local or national jurisdictions will lead to immediate termination of the User Account including any funds or transactions to and fro with the said user. Any countries prohibited by the international regulations shall be banned from using any of the stated services and privileges of the website. Usage of Proxy or other virtual methods for illegal access shall be considered to be banned based on the user integrity regulations.

Rights of Information and Data Ownership

ScholarOn and any managing entities of the website are the current and sole owners of any content in any form of data including text, logos, products, tools, coding, design, images, patterns or assembly and look and feel of the website or allied websites. Any content shared on ScholarOn belongs to the management entity unless otherwise limited by specific purchase agreements. Usage of any of the above data including resembling duplicates shall lead to DMCA or ensuing criminal or civil penalties on the offending parties. Any contributions in form of documents, books, text or images for the purpose of earning in-site credits is considered as paid for in full by the said credits being earned. All external publisher info including textbook cover images, university names and logos, names and logos of examination authorities such as CCH or CPA are used only for the purpose of identification and shall be taken down immediately post to the initiation of reporting procedures by the offended parties. ScholarOn does not endorse or affiliate with any academic institution.

End User License

The user licenses for all products on general sale including Solution Library, Flashcards, Document Sharing, Study Help Library and Textbook Solutions are non-exclusive, non-commercial licenses for personal use only. Exclusive, non-commercial licenses can be availed by opting to privacy option in the Study Help module and for any products purchased via Writing Services. No user is allowed to resell or duplicate any content purchased, with or without benefit, after any time duration from the purchase whatsoever. All user accounts are non-transferable and cannot be shared either. End users violating these terms shall be banned immediately with no liability on the part of the website towards any project completed or in progress including reworks.

Content Distribution Exceptions

ScholarOn and the Management shall allow distribution of content via Social Media Sharing only from our links or posts on our official social media pages. Embedding may be used as allowed for some products and tools by end users. No removal of logo or any modification of the code, replication or usage without permission shall be allowed for both paid and free tool embedding. Vendors supporting the site including micro sites or outsourced promotions must be validated by the management in writing for the usage of any of the Copyright material in such activities. Material shared for referencing such as journals or research papers belonging to the learner must be done so with proper information and citation or credit in the shared paper. ScholarOn has the exclusive rights to demand the takedown of any embedded link or widgets used in the Third Party Websites for all categories seen above.

Third Party Selling (Earning Credits)

Certain modules allow the sales of the user's own products or materials. Such material is considered the exclusive property of ScholarOn unless removed by the uploading user or taken down by our management for any manner of violations seen further in the violations clause. No direct or indirect promotions to any third-party website can be included in any part of the material being published on ScholarOn. The royalties are not negotiable and considered as been accepted by the act of posting the material to our website. Variable credits shall be decided only after checking and validating the information and the duration for such process will be informed before or after the upload depending on the scenario. Occasional takedown notices on any shared content for earning credits will only affect the content under question and not any membership privileges or access. Habitual offenders, however shall be warned and banning procedures shall be initiated resulting in restriction on membership access and privileges. Commercial Third-Party vendors are not covered under this agreement and must refer to their individual MOU's or Agreements signed under contract.

Limits and Expiry

The time limitation on any deal, purchase, download span or maximum number of usages per user shall be explicitly mentioned on any and all products and services hosted on the website. The same shall be considered as agreed to upon payment for the usage of the said service or product. Revisions to the above is the sole discretion of the management. Any limitation arising from restricted locations, suspicion of malpractice, similarity to past violators and penalties for restricted usage shall deem any contract or payment made towards the same null and void with no requirement of a prior notice on the part of the Site Owner.

Payment information Security

The website does NOT collect any payment information including but not limited to credit/debit card details, bank or any other nature of payment account information or any login keys to the above stated at any point of time either on the site or through personal contact such as E-mail, telephone or Live Chat. The payments shall be and shall only be processed in a secure page belonging to the payment gateway and not the website. Any incident of an employee or a liaison asking for any such information must be duly reported to the legal team and the same action must not be encouraged by a partial or complete sharing of the requested information.

Any and all losses arising out of the above situation shall not be the liability of the website to any extent however, the necessary support shall be provided post to an internal action until cessation of employment or contract as applicable to the individual/s if requested for a legal filing against the stated individual/s.

Deductable Charges

Any payment made through proper channels in lieu of current or future services of the website shall be taken within the authority of the payment team and any discrepancies arising due to a higher than expected payment by a numerical error or a negotiation to a lesser amount through another channel shall be decided upon a case to case basis. If the decision to return the excess is made, the to and fro processing charges shall be deducted post to the stated action.

Refund Due to Non-Delivery

A refund due to dissatisfaction of service shall be considered in full if and only if the task or deliverable paid for has not been initiated upon and no part or complete deliverables have been sent at any point of time during the agreed span of service or the deadline. All other scenarios shall be expected to resolve equivalent work compensations in an amicable fashion within the involved departments and the user with the advice from the payment department.

Refund Due to Quality Dissatisfaction

In case of a quality related discrepancy, the information must be provided with the due documents as requested by the payment department or the designated authority of the administrator to the satisfaction of the previously mentioned. A proper analysis with the involvement of subject experts would be considered appropriate before a final decision. Alternatively, a scanned grade sheet with the comments of the correctional authority for the deliverable shall be submitted for a quicker processing of the decision. In any case, minimal charges shall be held back for the service, basic expert payment and the payment processing charges back and forth before the final disclosure of the refundable amount.

With the due course of procedure, the processed refund shall be reflected within a maximum of 7 business days from the date of mutual agreement to settle and to the same source that the payment has been initiated from.

Medium of Refund

The finalized refund amount will only be transferred back to the source of payment.

Delivery and Quality Assurance

All projects, tasks and services paid for shall be considered with care to deliver the agreed digitized solutions to the satisfaction of the client. The assurance on quality is termed on a minimalistic basis and is subject to the effort and inputs needed form the customer in terms of prompt response to expert queries and availability of materials needed or made available per applicable scenario.

The users can demand to view a draft or partial deliveries only upon completing the payment in full as agreed and having provided the complete information as requested by the expert. A minimum of 24 hours would be needed if informed post to payment and confirmation process while a 48-hour window would be needed for the same request being made any time post to the stated timeframe.

Legality

Any disputes arising in execution of the above said terms would be dealt with in any court of competent jurisdiction as preferred by the opponent subsequent to approval by the legal dept under the SITEOWNER.

Copyright Policy

ScholarOn wishes to maintain a platform with no risk to being party of copyright infringement. We respect international and local intellectual property rights of our users and any other third party and insist upon adherence to the same by our users. We have made sufficient provisions in our user agreement for any person or organization using our services to host and store their content. No public display of any copyrighted material other than of his or her own creation or under the Fair Use Policy shall be allowed on any page of the website or downloadable content.

Kindly note that we do take responsibility, in good faith, to immediately inform the violator of the alleged infringement and initiate the due process to takedown any content infringing upon another entity's copyrights. Any content under dispute due to the above reason shall be temporarily restricted from generating any active or passive income for the user until the issue is resolved in favor to either parties of complaint. Habitual violators are liable to full restriction and permanent ban, based on our discretion, from further using our website for any purpose of publication of information.

All notices of infringement and counter-notices from defending users are considered as legal statements made with knowledge of penalty under perjury. Therefore, any parties involving in claims and counter-claims of the above nature are advised to go through the process with professional legal counsel though not mandatory.

Claims

In adherence to the Digital Millennium Copyrights Act, ScholarOn has implemented procedures to receive, validate and take necessary action on complaints regarding copyright infringement. This facility is handled by our legal team and can be initiated through this copyright infringement notification form, OR by flagging the content with the "Flag" button OR through written communication including the following details:

1. Electronic or physical signature of the copyright owner
2. Original link to your content that you think has been duplicated on our site
3. Description and link of the content that you think is infringing upon your copyright
4. Email, contact number and physical address of the content owner and representative in case of legal representation
5. A statement that the alleged violator, in your good faith does not own the content or authorized by the content creator or an agent or by the law
6. An accepting statement for liability and that you understand you are making this claim with the knowledge of penalty under perjury

Counter Claim

Sections 512(g)(2) and (3) of the Digital Millennium Copyright Act allow any individual or entity to counter a copyright claim if you, in good faith believe that the claim has been made improperly or inappropriate to the pursuant DMCA clauses of fair usage. Subject Matter Expert/Writer Job Contract

Welcome to ScholarOn, you are viewing this contract as you have completed form procedures, verification and subject matter/writing test as a part of the Expert Signup process. This contract will act as:

1. A NON-DISCLOSURE AGREEMENT,
2. AN EFFECTIVE WORKPLACE GUIDE AND
3. BINDING SERVICE INSTRUCTIONS

During and after your tenure as a SME/Writer with us. There will be a mandatory assessment after accepting the agreement and your acceptance is considered valid only if you clear the same.

Document Verification

You can only work in your own name and must provide proper documentation of ID proof in order to be eligible to receive payments for your projects. The payments will not be transferred to any third-party account under any circumstances. You agree, in your good faith, that this is your only Expert/Writer account with ScholarOn and that you have not falsified any information including identity, contact information, educational qualifications and experience stated during the sign-up process. Discovery of any of the above being inaccurate will result in a breach of this contract.

Projects

Any individual task with a deadline is considered a project. You can complete as many projects as you want within a payment cycle. However, we work with a strict one-on-one rule and so you cannot accept two projects at the same time. This does not apply to reworks. You can work on a maximum of one project and two reworks at a time. If the rework count is more than two, you will not be able to take up new projects before completing at least one of the two reworks in hand to student satisfaction.

Price Quotes

Non-writing domains such as Sciences, Math, Accounting, Finance, Taxation, and Technology have variable price quotes based on the complexity of the project. Writing Service projects have predetermined rates based on the word count and level of writing. Rookie and intermediate level SME/Writers will not be able to generate price quotes. You will receive the project details along with the price quote. You can accept or deny a project based on the same. However, you will be receiving projects without price quote as you increase your reputation with students through reviews and earn badges of achievement. You can decide the price quote for projects at this point and our Customer Support Representatives (known as Academic Advisors) will communicate the same to the student on your behalf.

Accepting a Project

You need to click on the "Accept Project" button on your dashboard and confirm it twice before you take up the project. This is just to avoid any mistakes wherein you might have clicked on the button by mistake. Contact Support button next to the Accept button allows you to speak to the specific Academic Advisor responsible for the project. The status of the project will move from "Deployed" to "Accepted" on your dashboard. Once you accept a project, you will be able to communicate with the student by clicking on the "Chat with Student" button that will replace the Accept Project button.

Communicating with the Student

Our policy is always inclined towards maximum benefit for the students, which you, being an academician, will agree with as well. Therefore, always be courteous, clear and precise in your communication. You will be immediately terminated if you are found communicating inappropriately with the student including being argumentative, rude, belittling, or sharing/trying to procure any personal contact information from the student. Kindly note that each conversation with the student and email is monitored and any misdemeanor on this note is not acceptable due to any reason. You can communicate with the student by clicking on Chat with Student button. You will only communicate with the student through the conversation thread that opens onto your right hand side. All other mediums of contact are prohibited with the exception of conference calls arranged by an Academic Advisor.

Customer Support Intervention

You can escalate or notify the concerned Academic Advisor in case of lack of information on the student's part, delayed response, misunderstandings or other issues with the project. The project will not be stopped unless you get direct and explicit instruction from an Academic Advisor to do so. Student requests to stop working on a project are not considered valid until an Academic Advisor confirms the same.

Project Delivery

All products must be delivered on time without exceptions. A draft of the project or proof that you have started working must be delivered within 2-3 hours of acceptance without fail. Long-term projects must be delivered in parts as designated by the Academic Advisor or the student. Failure to respond during end of deadlines may result in termination. Acceptable delays and valid issues will be considered while priority on in-time delivery is of paramount importance for customer satisfaction. Delivery time on reworks is 24 hours unless otherwise agreed upon by the student due to the complexity of the rework. Experts and writers are advised not to keep projects after completion and wait for the deadline. You can deliver a project as soon as you complete it in order to increase your project count.

Review and Ratings

Students rate every project on two grounds namely, expert ratings and product ratings. Your communications, courteousness, prompt response and professionalism are the parameters to earn your personal ratings. Project ratings are earned based on quality and usefulness of the completed project.
Various subjects and fields of writing have numerous badges of achievement attached to them and you can earn these badges by reaching the required volume and stars on each achievement. These badges along with the number of successful projects will take you to higher levels of expertise and earn you more projects.

Reworks

Reworks are a very real possibility while working on academic projects. The foremost rule in handling reworks would be "Never deny service till the student is satisfied". This rule is the key behind customer satisfaction and retention. Do not flinch away from reworks and you can always request intervention from an Academic Advisor if you feel the rework is out of proportion or is due to missing information on the customer's part.

Project Failure

Any project is considered a failure if the customer is not satisfied even after three reworks. The project will be reassigned to another expert and payment will be cancelled for the same. Plagiarism is another reason for direct failure. Three free plagiarism checks are available for every project, one for the draft and two for other stages of the project. If you are unable to remove plagiarism even after the third check, then project will be reassigned in order to ensure delivery. Project failure is a rare scenario and can be avoided by simply working with due diligence on each project.

Compensation and Cycle of Payment

Your compensation for every project is 70% of the price quote less transaction charges. All projects have a 30-day window for opening refunds or disputes from the customer's end and so, the payment will be released on the 30th day of delivery of every project. Such payments are added to your account and you can check this on your dashboard. You have the option to set a 15 days or monthly payment cycle. Any collected income in your account will be transferred to your preferred bank or PayPal account on the 2nd of every month for a monthly billing cycle and on 2nd and 16th of each month for a bimonthly cycle.

Code of Honor

There are certain practices that must be avoided in order to maintain our academic integrity and to keep all our services legally above board

1. Never login to the student's account under any circumstances
2. Do not ask for any personal information from any student
3. Do not communicate outside the Student Chat thread with any student
4. Do not use the same project solution EVER for two different orders however old it is
5. Never be rude to the student
6. Communicate only in English and take assistance from an Academic Advisor if the student has difficulty with reciprocating in English
7. Do not highjack the student EVER
8. Never indulge in intentional plagiarism
9. Never take any online exam on behalf of the student as it is considered identity theft

All decisions by Academic Advisors are final in any matter regarding deployment, assigning, revoking, withholding or cancelling a project and payments towards the same.
Any SME/Writer found breaking this code of honor would be terminated immediately with no liability on any pending compensations.

Liability Clauses

The site holds no liability over claims of DMCA, content abuse, unsafe or biased content that may be posted as a part of any assignment or towards the study help library.
All claims of DMCA violation will be forwarded to the expert/writer involved and payment shall be kept on hold until the same is resolved.

Non-Disclosure and Data Rights

You are entering into a default Non-Disclosure Agreement by signing up as a SME/Writer with ScholarOn. All data created for ScholarOn is assumed exclusive and is considered the sole property of ScholarOn Management since you are compensated for the same. Therefore, reselling or replicating the same data in any electronic or physical formats with or without monetary or equivalent benefit is considered as a breach of this Non-Disclosure clause and will result in Termination with no liability on our part to any compensations pending, promised or held in lieu of any manner of payment contract.

Voluntary Discontinuation of Service

If you, for any reason wish to quit working for ScholarOn, a 15-day notice or the current project span whichever is greater must be provided in writing. Completion of all projects and reworks is mandatory to receive your final settlement of any monies available in your account. Improper discontinuation will result in the compensation being nullified. You will continue to uphold the non-disclosure clause for an indefinite period under the knowledge of legal penalties associated with breaching the same.

Termination and Loss of Compensation

If you are terminated for any reason mentioned in this contract or other misdemeanors as appraised by ScholarOn management, the website is not liable for any compensation held in lieu of completed projects. You will continue to uphold the non-disclosure clause even after termination under the knowledge of legal penalties associated with breaching the same.

Interpretation and Revisions

Kindly note that any changes to these terms are the sole right of the Management and you will be notified on updates. We deem it your responsibility to adhere to the same as well. All interpretations to the sense and meaning of this agreement are as stated by the Management. Kindly clarify any queries with your recruiting officer.
